General Product Safety Regulations

Section 1: General provisions

Article 1: Scope of application

(1) This Regulation shall apply to the manufacture, distribution and use of watch straps intended for the European market.
(2) The aim of this Regulation is to ensure a high level of product safety in order to protect the health and safety of consumers.

Article 2: Definitions

For the purposes of this Regulation, the following definitions shall apply:

1. watch strap: a strap specifically intended to be worn with a watch on the wrist.

2. manufacturer: means any natural or legal person who manufactures a watch strap or has a watch strap designed and markets it under his own name or trademark.

3. distributor: any natural or legal person in the supply chain who makes the watch strap available on the market.

4. consumer: any natural person who uses a watch strap for purposes which are outside his trade, business, craft or profession.

Section 2: Safety requirements

Article 3: General safety requirements

(1) Watch straps shall be designed and manufactured in such a way that they do not endanger the health and safety of consumers under normal or reasonably foreseeable conditions of use.
(2) Watch straps shall comply with the applicable European standards. In the absence of a specific standard, they shall comply with the generally recognized rules of technology.

Article 4: Specific safety requirements

1. material: watch straps must not contain any harmful substances or materials which may be harmful to health on contact with the skin. The types of leather used must be free of harmful substances and harmful chemicals. This includes in particular Prohibition of chromium (VI) and other allergens or carcinogenic substances in accordance with Regulation (EC) No. 1907/2006 (REACH Regulation).

2. mechanical strength: watch straps must have sufficient strength and durability to withstand daily use without breaking.

3. closing mechanism: The closing mechanism of the watch strap must ensure that the strap remains firmly on the wrist and does not open unintentionally.

Section 3: Conformity assessment and market surveillance

Article 5: Conformity assessment

(1) Before placing a watch strap on the market, the manufacturer shall carry out or have carried out a conformity assessment to confirm the conformity of the product with the applicable safety requirements.

Article 6: Market surveillance

(1) The competent authorities of the Member States shall be responsible for ensuring compliance with this Regulation through market surveillance measures.
(2) In the event of non-compliance with this Regulation, the competent authorities shall have the power to take appropriate measures, including recalls and sales bans.

Section 4: Obligations of economic operators

Article 7: Obligations of the manufacturer / importer

a. The manufacturer / importer is responsible for ensuring that the device complies with the requirements of this Regulation.
b. Product tests must be carried out regularly to ensure compliance with the safety requirements.
c. The manufacturer must set up a product traceability system (logo, name and article number).

Article 8: Obligations of distributors

a. Distributors shall only make available on the market products which comply with the requirements of this Regulation.
b. Distributors must ensure that the products are properly labeled.

Section 5: Final provisions

Article 9: Entry into force

This Regulation shall enter into force on 13.12.2024.

Article 10: Transitional provisions

Watch straps placed on the market before the entry into force of this Regulation shall be subject to a transitional period of 2 years during which they may comply with the previous regulations.

Article 11: Penalties

Infringements of this Regulation shall be sanctioned in accordance with the national legislation of the Member States.

This Regulation ensures that watch straps placed on the European market are safe and do not endanger the health of consumers. All economic operators are obliged to comply with the specified requirements and to take appropriate measures to ensure product safety.
